By enrolling in a Fyne Home Care plan, you are entering into a structured home maintenance service designed to provide proactive oversight, preventative maintenance, and optional concierge services for your property.
Monthly plans require a 12-month minimum commitment. Early cancellation may result in an early termination charge as described below.
Terms of the agreement:
12-Month Commitment:
All plans require a twelve (12) month service commitment. Monthly billing is a payment option and does not convert the agreement to a month-to-month arrangement.
Preventative, Not Insurance:
Services are preventative and observational in nature. This agreement is not a warranty, insurance policy, or guarantee against system failure.
Emergency Support:
Members receive priority scheduling and access to fixed-rate emergency services where applicable.
Concierge Services:
Concierge services are time-based enhancement and improvement services and may be purchased separately or bundled with the Guardian Home Care Plan.
Scheduling & Access:
Clients agree to provide reasonable access to the property to perform scheduled services.
Electronic Acceptance:
Submitting payment or enrolling online constitutes agreement to the full terms outlined below.

Introduction
This Service Agreement (“Agreement”) is made between Fyne Property Maintenance & Management (“Fyne M&M,” “Service Provider”) and the enrolling client (“Client”).
This Agreement outlines the terms under which Fyne M&M provides home maintenance, concierge, and bundled home care services.
By enrolling in a Fyne Home Care plan, submitting payment, or electronically accepting this Agreement, the Client agrees to be bound by the terms below.
1. Services Provided
Fyne M&M provides subscription-based home maintenance services and time-based concierge services as described in the applicable Service Schedules below.
Services are observational and preventative in nature unless otherwise agreed in writing. Services do not constitute insurance, a warranty, or a guarantee against system failure.
1.1 Fyne Guardian Home Care
FYNE Guardian Home Care includes a complementary introductory home inspection upon enrollment and bi-annual whole-home maintenance check-ins.
Scope includes, but is not limited to:
Roof and attic inspection
HVAC system review
Plumbing checks
Electrical inspection
Appliance review
Safety device testing
Window and door inspection
Exterior and foundation evaluation
General interior maintenance review
Emergency services may be available as outlined in the applicable Service Schedule and are subject to additional charges unless otherwise specified.
1.2 Fyne Concierge Home Care
Concierge services provide time-based home enhancement and convenience services, including but not limited to:
Exterior enhancements
Interior customization
Home aesthetic improvements
Convenience services
Comfort and accessibility services
Concierge services do not include structural modifications or licensed trade work unless separately agreed in writing.
2. Payment Terms
Payment is due according to the selected plan at the time of enrollment.
Pricing, billing frequency, and service scope are set forth in the applicable Service Schedule or pricing description presented to the Client at enrollment.
All payments are processed electronically.
Failure to maintain an active payment method may result in suspension of services.
Fees paid for services already rendered are non-refundable.
3. Service Scheduling
Services will be scheduled at mutually agreeable times.
The Client agrees to provide safe access to the property and disclose known hazards.
Missed appointments or denied access may count as completed visits.
Emergency services are prioritized according to plan terms but are not guaranteed to be immediate.
4. Term and Termination
Minimum Service Term
FYNE Guardian Home Care plans require a minimum service term of twelve (12) months. The twelve (12) month service term begins on the date of enrollment and initial payment (the ‘Effective Date’).
Billing may occur monthly or annually; however, the minimum service commitment remains twelve (12) months regardless of billing frequency.
Early Termination
If Client elects to terminate this Agreement prior to completion of the twelve (12) month term, Client agrees to pay an early termination charge equal to fifty percent (50%) of the total remaining payments due under the twelve (12) month service term.
The early termination charge is intended to reasonably compensate Fyne M&M for administrative costs, scheduling allocation, and resources reserved for the Client’s service plan.
The early termination charge shall be due immediately upon termination and may be invoiced separately.
Annual Plans
Annual plans are prepaid and non-refundable upon enrollment and initial payment
5. Liability and Insurance
Fyne M&M maintains general liability insurance for work performed under this Agreement.
Fyne M&M is not responsible for pre-existing conditions, hidden defects, or damages not caused by our negligence.
Inspections and observations are based on visible conditions at the time of service.
6. Client Responsibilities
The Client agrees to:
Provide reasonable access to the property
Secure pets
Maintain safe working conditions
Disclose known hazards
Fyne M&M reserves the right to refuse service in unsafe conditions.
7. Dispute Resolution
Any disputes shall first be attempted to be resolved through mediation.
If mediation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
8. Governing Law
This Agreement shall be governed by the laws of the State of Michigan.
9. Entire Agreement
This Agreement, together with its applicable Service Schedules and written addendums, constitutes the entire agreement between the Parties and supersedes all prior discussions or agreements.
10. Electronic Acceptance
This Agreement may be accepted electronically, including through online checkout or electronic acknowledgment. Such acceptance shall be deemed legally binding and enforceable to the fullest extent permitted by law.
Client acknowledges that recurring payments may be automatically charged to the payment method on file according to the selected billing frequency.
Service Schedules
Schedule A – Guardian Home Care
Guardian Home Care is a preventative home maintenance subscription designed to support proactive home system care.
Emergency services provide priority response and predetermined pricing where applicable, but do not guarantee immediate service or complimentary repairs.
Schedule B – Concierge Home Care
Concierge services are provided through annual hour-based packages.
Monthly billing represents a payment option and does not convert the service to a month-to-month arrangement.
Unused hours do not roll over unless otherwise stated in writing.
Schedule C – Bundled Services
Bundled pricing combines Guardian Home Care and Concierge Home Care at a discounted rate.
Bundled pricing applies only while all bundled services remain active. Modification or cancellation of any bundled service will result in repricing of remaining services at standard rates.
Agreement Acceptance
By enrolling in a Fyne Home Care plan, submitting payment, or electronically accepting this Agreement during checkout, the Client acknowledges that they have read, understand, and agree to be legally bound by this Agreement and its applicable Service Schedules.
